Understanding Subrogation & Recovery Claims in the UAE

Subrogation allows an insurer that has paid a claim to step into its insured’s shoes and recover the amount paid from the third party responsible for the loss. In the UAE this right arises by statute under the Civil Code — operating automatically upon payment, to the extent of the indemnity paid — and is commonly reinforced by a contractual subrogation clause in the policy. The insured retains the right to recover any uninsured portion of the loss from the same third party in its own name.

Successful recovery work is evidence-driven and time-sensitive: liability must be established against the third party under ordinary tort or contract principles, quantum must be proved by the claims file, and limitation must be protected from the date of the underlying event. It is the insurer’s right, after paying a claim, to pursue the party responsible for the loss and recover what it paid. In the UAE the right arises by law upon payment of the indemnity and is usually confirmed by the policy wording.
After paying the insured, the insurer assembles the claims file — proof of payment, cause of loss, and quantum — puts the responsible party on notice, and pursues recovery through negotiation or court proceedings. The recoverable amount is capped at what the insurer actually paid.
Common defences include contributory fault, absence of causation, challenges to quantum and the reasonableness of the underlying settlement, waiver of subrogation clauses in the underlying contracts, and limitation. Early legal review often identifies a complete or partial defence.
