Subrogation allows an insurer that has paid a claim to step into its insured’s shoes and recover the amount paid from the third party responsible for the loss. In the UAE this right arises by statute under the Civil Code — operating automatically upon payment, to the extent of the indemnity paid — and is commonly reinforced by a contractual subrogation clause in the policy. The insured retains the right to recover any uninsured portion of the loss from the same third party in its own name.
Successful recovery work is evidence-driven and time-sensitive: liability must be established against the third party under ordinary tort or contract principles, quantum must be proved by the claims file, and limitation must be protected from the date of the underlying event. We run subrogated recoveries as portfolios for insurers — from motor and property recoveries to marine, engineering, and liability lines — and we defend businesses and individuals against recovery actions, where contributory fault, causation, and quantum challenges frequently reduce or defeat the claim.
