The UAE substantially modernised its IP laws in 2021, and we work across the full set: the Trademarks Law (Federal Decree-Law No. 36 of 2021), the Copyright and Related Rights Law (Federal Decree-Law No. 38 of 2021), and the Industrial Property Law (Federal Decree-Law No. 11 of 2021), which governs patents, utility certificates and industrial designs. Just as importantly, the UAE is a member of the Madrid Protocol for international trademark registration and the Patent Cooperation Treaty for patents — which means protection secured here can be extended efficiently across many other countries. Enforcement runs through the Ministry of Economy, the customs authorities and the courts, and we use each of these channels as the situation demands.
Protection is only the first step; IP earns its value when it is put to work. We advise on licensing and assignment — the agreements through which IP is monetised, franchised or transferred — and we conduct IP due diligence in M&A, investment and financing, where the strength and ownership of a target’s IP can make or break a deal.
