Intellectual Property — Protecting and Commercialising Your Intangible Assets

For many businesses, the most valuable thing they own cannot be touched: a brand, an invention, a piece of software, a body of creative work. Intellectual property is what turns those intangibles into protected, ownable, tradeable assets — and protecting them is a commercial decision as much as a legal one. ABR Advocates & Legal Consultants helps clients identify, register, commercialise and defend their IP, treating it as the strategic asset it is rather than a box-ticking formality.

The UAE intellectual property framework

The UAE substantially modernised its IP laws in 2021, and we work across the full set: the Trademarks Law (Federal Decree-Law No. 36 of 2021), the Copyright and Related Rights Law (Federal Decree-Law No. 38 of 2021), and the Industrial Property Law (Federal Decree-Law No. 11 of 2021), which governs patents, utility certificates and industrial designs. Just as importantly, the UAE is a member of the Madrid Protocol for international trademark registration and the Patent Cooperation Treaty for patents — which means protection secured here can be extended efficiently across many other countries. Enforcement runs through the Ministry of Economy, the customs authorities and the courts, and we use each of these channels as the situation demands.

Securing rights, then making them work

Protection is only the first step; IP earns its value when it is put to work. We advise on licensing and assignment — the agreements through which IP is monetised, franchised or transferred — and we conduct IP due diligence in M&A, investment and financing, where the strength and ownership of a target’s IP can make or break a deal. Where rights are infringed, we move from protection to enforcement: infringement actions, a proactive anti-counterfeiting strategy, and litigation before the courts or, where appropriate, arbitration.

Managing global portfolios

Few brands or inventions live in a single country. We help clients build and manage IP portfolios that span multiple jurisdictions, using the international systems the UAE belongs to and coordinating local counsel where needed, so that protection is consistent, renewals are not missed, and enforcement can be pursued wherever a problem arises.

A commercial approach

We give equal weight to the law and to the business behind it. That means advising not just on whether something can be protected, but on what is worth protecting and why, and framing IP strategy around competitive position, brand value and commercial goals. Our clients range across technology, creative, manufacturing, FMCG and other sectors, and we keep the advice accessible whether you are an IP manager or a founder protecting your first mark.

Ask a question
A trademark protects the signs that identify your brand — names, logos and marks — and can be renewed indefinitely. A patent protects a new invention or technical solution for a limited term. They are different rights under different laws with different registration routes, and many businesses need both.
Through a layered strategy: register your trademark, record your rights with the customs authorities, monitor the market, and take enforcement action — an administrative complaint, a civil claim, or a criminal referral — against infringers. We design that strategy and run the enforcement.
Yes. As a member of the Madrid Protocol, the UAE lets you seek trademark protection in many countries through a single international application; for patents, the Patent Cooperation Treaty offers a comparable route. We coordinate multi-jurisdiction filings and portfolios.
Trademark filing and protection is about securing the registered right. Brand protection and anti-counterfeiting is the ongoing, proactive effort to stop your brand being copied or misused. An infringement action is the specific legal proceeding you bring once a right has actually been violated. Most brand owners need all three at different times.
