Understanding Criminal Defence Representation in the UAE

Facing a criminal charge in the UAE is a serious matter. The Crimes and Penalties Law (Federal Decree-Law No. 31 of 2021) and the Criminal Procedure Law (Federal Decree-Law No. 38 of 2022) govern a process that moves in defined stages — police, Public Prosecution, Court of First Instance, Appeal, and Cassation — and for non-citizens a conviction can carry deportation in addition to any penalty. Proceedings are conducted in Arabic, and the case file assembled during the investigation is the raw material on which the entire trial is built.

Effective defence work starts early and is built on the file: obtaining and analysing every document, challenging the evidence and procedure where the law allows, presenting defence memoranda that engage the specific elements of the charged offence, and where appropriate pursuing settlement or waiver of the personal right in offences where reconciliation ends or mitigates the case. Typically: police complaint and investigation, referral to the Public Prosecution, prosecution investigation, referral to the competent criminal court, trial and judgment, then appeal and — on points of law — cassation.
