The legal route your divorce takes depends primarily on your religion and, in some cases, your Emirate of residence. For Muslim spouses, divorce is governed by the Personal Status Law under Federal Decree-Law No. 41 of 2024. The law recognises divorce by the husband (talaq), divorce at the wife’s instance in exchange for consideration (khula), and judicial divorce on grounds such as harm, non-maintenance, desertion, or irreconcilable discord. Most contested matters pass through the Family Guidance section for an attempt at conciliation before proceeding to court.
For non-Muslim residents, Federal Decree-Law No. 41 of 2022 fundamentally changed the landscape by introducing no-fault divorce. Either spouse may request divorce unilaterally without proving harm or assigning blame, and the court may grant it at an early hearing without a mandatory conciliation stage. Non-Muslim couples in Abu Dhabi benefit from the Civil Family Court’s streamlined, bilingual procedures under Law No. 14 of 2021.
Divorce also triggers consequential questions — custody, maintenance, alimony, the family home, and division of jointly acquired assets — each of which must be addressed strategically from the outset.
