Understanding Family Mediation & Settlement

Amicable resolution is built into the UAE family justice system itself. Most personal status disputes between Muslim spouses are first referred to the Family Guidance section, where a trained counsellor attempts conciliation before the matter proceeds to a judge. Far from being a formality, this stage is a genuine opportunity: agreements reached before Family Guidance can be recorded and ratified, acquiring the force of an enforceable judgment while remaining entirely confidential.

Beyond the court-annexed process, parties may pursue private mediation and structured settlement negotiation at any stage — before filing, during proceedings, or even at appeal. A comprehensive settlement can resolve divorce, custody, visitation, maintenance, and financial division in a single coordinated agreement, drafted precisely and submitted for ratification. For non-Muslim couples under Federal Decree-Law No. 41 of 2022, settlement agreements on alimony, joint custody arrangements, and asset division are similarly embraced by the civil courts.

The value of legal representation in mediation is often misunderstood.
