Most personal status disputes between Muslim spouses are first referred to the Family Guidance section, where a trained counsellor attempts conciliation before the matter proceeds to a judge. Far from being a formality, this stage is a genuine opportunity: agreements reached before Family Guidance can be recorded and ratified, acquiring the force of an enforceable judgment while remaining entirely confidential.
Beyond the court-annexed process, parties may pursue private mediation and structured settlement negotiation at any stage — before filing, during proceedings, or even at appeal. A comprehensive settlement can resolve divorce, custody, visitation, maintenance, and financial division in a single coordinated agreement, drafted precisely and submitted for ratification. For non-Muslim couples under Federal Decree-Law No. 41 of 2022, settlement agreements on alimony, joint custody arrangements, and asset division are similarly embraced by the civil courts.
