Mediation works when both sides are willing to talk but cannot close the gap alone. A neutral mediator manages the discussion, tests each side’s position privately, and helps the parties build a settlement neither could have reached across a table on their own. In debt matters, its great advantage is that the outcome can be documented to bite: enforceable if the debtor later defaults.
Mediation in the UAE is governed by the Mediation and Conciliation Law (Federal Decree-Law No. 40 of 2023), which modernised the regime — recognising private and court-annexed mediation, protecting the confidentiality of the process, and giving properly concluded settlement agreements real legal force. That last point transforms mediation from a polite conversation into a genuine recovery tool.
We advise on whether your dispute suits mediation, prepare your position and settlement parameters, represent you through the sessions, and — critically — document the settlement so that it is enforceable, with security, instalment and default provisions that anticipate what a struggling debtor may do next.
