UAE law recognises that the non-custodial parent retains the right to see, visit, and maintain a genuine relationship with their child. Under the Personal Status Law (Federal Decree-Law No. 41 of 2024), the court will determine visitation where parents cannot agree — specifying days, times, locations, overnight stays, and holiday contact. Judges increasingly favour detailed, workable schedules over vague orders, and the child’s schooling, age, and routine are central to what the court will approve.
The most durable arrangements, however, are the ones parents agree between themselves. A negotiated parenting plan — covering the weekly schedule, school holidays, Eid and other occasions, travel, phone and video contact, and how future disagreements will be resolved — can be recorded in a binding settlement and ratified by the court, giving it the force of a judgment while sparing the family adversarial litigation.
Where an existing arrangement is being obstructed — visits denied, handovers frustrated, or a child being turned against a parent — the law provides remedies. Persistent denial of visitation can be enforced through the execution court and may, in serious cases, justify reconsidering custody itself. Conversely, if genuine safety concerns exist, supervised visitation can be requested.
