Reports and opinions — what we produce, and why they matter

A legal opinion is a lawyer’s reasoned analysis of how the law applies to a particular set of facts — used to guide a decision, support a transaction, or satisfy a requirement imposed by a counterparty or regulator. An expert report is a formal, often independent, written analysis prepared as evidence or specialist input: on the quantum of a claim, on a technical or contractual question, or on the content of a particular law where that is treated as a matter to be proved.

Both are strategic documents, not formalities. A well-constructed opinion lets a board act with confidence; a credible expert report can be decisive in a dispute. Their value lies in being right, being clear, and being genuinely independent.

Where our work is used

Our reports and opinions are prepared for the forum in which they will be used, each of which has its own expectations:

Onshore UAE courts, where proceedings rely heavily on court-appointed experts (khibra), and where well-framed submissions and analysis shape how that expert’s findings are received.

Arbitration, before institutions such as DIAC and the ICC, where party-appointed expert reports — on quantum, delay, or technical issues — are a central feature of the process.

The DIFC and ADGM courts, common-law jurisdictions in which party-appointed expert evidence and formal legal opinions follow international practice.

Regulatory authorities, where opinions confirm compliance or address a specific requirement.

Boards and counterparties, where due-diligence reports and transactional opinions inform high-stakes commercial decisions.

How we work

Four qualities define our reports and opinions:

Independence. The analysis follows the law and the evidence to an honest conclusion — including where that is not the answer the client hoped for. A document that reads as advocacy carries little weight; an objective one is persuasive precisely because it is objective.

Rigour. Conclusions are researched, reasoned and tied to the applicable law and facts, so they hold up under scrutiny.

Clarity. Complex issues are explained so that the intended reader — a judge, a tribunal, a regulator or a board — can act on them without wading through jargon.

A legal opinion is a lawyer’s reasoned view on how the law applies to your facts, used to guide a decision or satisfy a requirement. An expert report is a formal analysis prepared as evidence or specialist input — for example on damages, a technical issue, or the content of a particular law in another forum. They overlap, but serve different audiences and purposes.
Most often in financing, acquisitions and cross-border deals, where a lender, investor, counterparty or regulator wants formal confirmation on points such as a company’s capacity to enter the deal, the validity and enforceability of the agreement, or compliance with local law — before they commit.
In onshore litigation, the courts rely principally on court-appointed experts, though the parties submit analysis and challenge those findings. In arbitration and before the DIFC and ADGM courts, party-appointed expert reports are standard. We prepare each report to suit the forum in which it will be used.
Independence means the conclusion follows the law and evidence honestly, rather than simply supporting the client’s preferred outcome. It matters because courts, tribunals and regulators give weight to objectivity — a report that reads as advocacy persuades no one, while a genuinely independent one carries real influence.
